Terms & Conditions
These Terms and Conditions set out the basis on which Thayat provides inheritance legal support services. We have written them in plain language where possible. If you have any questions before engaging our services, we are always happy to go through them with you at your own pace.
Definitions
Throughout these Terms, the following words carry the meanings set out below:
- "Agreement" means these Terms and Conditions, together with any engagement letter or service confirmation issued by us.
- "We", "Us", "Our" refers to Thayat, a legal support services firm operating at 36 Mun Muang Road, Si Phum, Chiang Mai 50200, Thailand.
- "You", "Client", "User" refers to any individual or entity who engages Thayat's services, visits this website, or submits an enquiry through any channel we operate.
- "Services" means the inheritance legal support services described in Section 3 and any related assistance we provide.
- "Content" means all materials, documents, written guidance, templates, and information made available through our website or in the course of providing Services.
- "Matter" refers to a specific inheritance case or estate-related issue for which you have sought our assistance.
- "Engagement" means the formal commencement of a professional relationship between you and Thayat for a specific Matter.
- "PDPA" means Thailand's Personal Data Protection Act B.E. 2562 (2019) and any regulations issued under it.
Acceptance of Terms
By visiting our website, submitting an enquiry, attending a consultation, or engaging our Services in any capacity, you confirm that you have read, understood, and agree to be bound by this Agreement.
Our Services are intended for individuals who are at least 18 years of age and who have the legal capacity to enter into a binding agreement. If you are acting on behalf of an estate or another person, you confirm that you have the authority to do so.
If any part of these Terms is unclear or causes concern, please contact us before proceeding. We would rather take time to address your questions than have any misunderstanding arise later.
Service Description
Thayat provides inheritance legal support services in Chiang Mai, Thailand. Our work is focused on helping heirs and families navigate estate matters with patience and clarity. The three principal services we offer are:
- Heir Guidance Meeting (฿3,700): An initial session to explain what an inheritance matter involves, set out the steps ahead in plain terms, and answer your questions at your own pace.
- Claim and Documentation Support (฿5,700): Careful assistance preparing the documents an inheritance matter requires, with clear updates throughout so you always know where things stand.
- End-to-End Estate Support (฿7,900): Patient representation across an inheritance matter from documentation through to formal steps, handled with sensitivity to the family's circumstances.
Services are delivered primarily in Chiang Mai and, where applicable, through correspondence or documentation support relating to matters under Thai jurisdiction. We may decline to assist with matters that fall outside the scope of our expertise or geographic remit, and will advise you of this at the earliest opportunity.
User Responsibilities
When working with us, we ask that you:
- Provide accurate, complete, and timely information about yourself and the Matter at hand.
- Notify us promptly if any information you have provided changes or if new relevant facts come to light.
- Supply original documents or certified copies as requested, in a timely manner.
- Respond to communications from our team within a reasonable period so that your Matter is not delayed.
- Use our website and any materials we provide only for lawful purposes related to your inheritance matter.
- Refrain from using any Content we provide in a manner that could mislead others or misrepresent our work.
- Not attempt to use our services to facilitate any activity that is unlawful under Thai law or the laws of any other applicable jurisdiction.
We understand that navigating an inheritance matter can feel unfamiliar. If you are uncertain about what information is needed or why, please ask us — we are here to guide you.
Intellectual Property
All content on our website — including text, layout, design, graphics, and written materials — is the property of Thayat or its licensors and is protected under Thai intellectual property law.
We grant you a limited, personal, non-transferable licence to access and use our website and any materials we provide solely in connection with your own inheritance matter. This licence does not permit you to:
- Copy, reproduce, or redistribute our content for commercial purposes.
- Modify or adapt any materials without our written consent.
- Use our name, logo, or branding in any way without prior approval.
- Share any document templates or written guidance we provide with third parties outside your immediate Matter.
Any documents, letters, or written work prepared by us for your specific Matter remain the intellectual property of Thayat until all fees relating to that work have been settled in full.
Payment Terms
All fees are quoted and payable in Thai Baht (฿). The service fees are as stated in Section 3 and in any written engagement confirmation we provide.
Payment schedule
For the Heir Guidance Meeting, payment is due prior to the session being confirmed. For Claim and Documentation Support and End-to-End Estate Support, we will agree a payment schedule with you at the outset of the Engagement, which may include an initial deposit and staged payments.
Payment methods
We accept bank transfer to our designated account and such other methods as we may communicate to you in writing. Details will be provided on request or in your engagement confirmation.
Refunds and cancellations
If you need to cancel or reschedule, please let us know as early as possible. Refund eligibility is as follows:
- Cancellations made more than 48 hours before a scheduled meeting: a full refund is available upon request.
- Cancellations within 48 hours of a scheduled meeting: a credit toward a future appointment may be offered at our discretion.
- For ongoing service Engagements, fees paid for work already completed are non-refundable. Any unspent portion of a deposit relating to work not yet commenced will be returned to you within 14 days of written cancellation.
If fees remain unpaid beyond the agreed period, we reserve the right to pause work on your Matter until the outstanding balance is settled.
Service Delivery Terms
We will carry out your Matter with reasonable care, skill, and patience. Our aim is always to make the process feel as clear and manageable as possible.
Scope
The scope of work will be confirmed in writing at the start of each Engagement. Any significant change to scope — whether requested by you or arising from the circumstances of the Matter — will be discussed and agreed before additional work proceeds.
Timelines
Timelines for inheritance matters in Thailand can depend on court schedules, third-party processes, and the completeness of documentation provided. We will give you our best honest estimate at the outset and keep you informed as the Matter progresses. We cannot commit to fixed completion dates where these depend on factors outside our control.
Your involvement
Some steps in an inheritance matter require your personal attendance or signature. We will give you clear advance notice of any such requirements so that you can plan accordingly.
Confidentiality
We treat all information you share with us as confidential. We will not disclose your personal details, family circumstances, or the specifics of your Matter to any third party except:
- Where necessary to progress your Matter (for example, submitting documents to a court or government authority).
- Where you have given your written consent.
- Where we are required to do so by Thai law or a lawful order from a competent authority.
Our handling of your personal data is also governed by our Privacy Policy, which sets out your rights under the PDPA in detail.
Disclaimers
Our services are provided with care and professionalism, but we wish to be transparent about certain limitations:
- The information on our website is for general guidance only and does not constitute legal advice. Each inheritance matter is unique and the general information on this site may not apply to your specific circumstances.
- We cannot predict or control the decisions of courts, government authorities, or other parties involved in your Matter.
- Outcomes in inheritance matters depend on many factors, including the accuracy of information provided to us, the applicable law, and third-party decisions. We do not represent that any particular outcome can be achieved.
- Our website is provided in good faith and we aim to keep information current, but we make no warranty that the content is complete, accurate, or up to date at all times.
If you are uncertain whether our services are right for your situation, we encourage you to ask questions before committing to any service. An initial Heir Guidance Meeting is specifically designed to help you understand what is involved.
Limitation of Liability
To the fullest extent permitted by applicable Thai law, Thayat's total liability to you in connection with any Matter or Engagement shall not exceed the total fees paid by you for the specific Service giving rise to the claim.
We shall not be liable for:
- Loss of income, business, or opportunity arising from any delay or adverse outcome in your Matter.
- Losses resulting from inaccurate or incomplete information provided to us.
- The actions or decisions of courts, government bodies, or other third parties involved in your Matter.
- Circumstances beyond our reasonable control, including changes in law, court closures, natural events, or public health measures.
Nothing in this Agreement limits liability for fraud, gross negligence, or matters that cannot be limited under Thai law.
Indemnification
You agree to hold Thayat, its staff, and its representatives harmless from any claims, costs, or losses that arise directly from:
- Inaccurate or misleading information provided to us in connection with your Matter.
- Your breach of any part of this Agreement.
- Your use of our Content or Services for any purpose other than as intended and agreed.
This indemnification does not apply to losses caused by our own negligence or breach of duty.
Termination
By you
You may end an Engagement at any time by notifying us in writing. Fees for work already completed up to that point remain payable. Any unspent deposit for work not yet begun will be returned to you within 14 days, in accordance with Section 6.
By us
We may suspend or conclude our involvement in a Matter if:
- Fees remain unpaid beyond an agreed period despite reasonable communication from us.
- We receive information that materially changes the nature of the Matter in a way that falls outside our scope or ethical obligations.
- Continued involvement would be contrary to any applicable law or professional standard.
We will give you reasonable notice wherever possible and will take steps to minimise disruption to your Matter.
Survival
Sections relating to intellectual property, confidentiality, disclaimers, limitation of liability, indemnification, and dispute resolution continue to apply after any termination of this Agreement.
Dispute Resolution
This Agreement is governed by the laws of the Kingdom of Thailand. Any dispute arising from it shall be subject to the jurisdiction of the competent courts in Chiang Mai, Thailand.
Informal resolution
We would always prefer to resolve any concern informally. If you have a question or complaint, please contact us first at [email protected] and give us the opportunity to address it. We commit to responding within five working days and to working with you in good faith toward a resolution.
Formal process
If informal resolution is not achieved within 30 days of your written notice to us, either party may refer the matter to mediation through a mutually agreed mediator in Chiang Mai. Where mediation does not resolve the dispute, the parties may proceed to the relevant Thai court of competent jurisdiction.
Relevant Thai consumer protection legislation, including the Consumer Protection Act B.E. 2522 (1979) as amended, applies where applicable.
General Provisions
- Entire Agreement: This Agreement, together with any written engagement confirmation, constitutes the full understanding between you and Thayat in relation to the Services.
- Severability: If any provision of this Agreement is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full effect.
- Waiver: Failure by either party to enforce any right under this Agreement on one occasion shall not constitute a waiver of that right on future occasions.
- Assignment: You may not transfer your rights or obligations under this Agreement without our written consent. We may assign our obligations to another qualified professional where necessary, in which case we will notify you in advance.
- Notices: Notices under this Agreement may be sent by email or post. Notices to us should be addressed to [email protected] or to our office address. Notices to you will be sent to the contact details you provided at the time of Engagement.
- Language: This Agreement is written in English. In the event of any conflict between an English version and a Thai translation, the English version shall prevail unless otherwise agreed in writing.
Changes to Terms
We may update these Terms from time to time to reflect changes in our services, applicable law, or operational practice. When we make changes, we will update the "Last updated" date at the top of this page.
We will take reasonable steps to notify you of material changes, including by posting a notice on our website. Continued engagement of our Services after the effective date of any change constitutes your acceptance of the updated Terms.
If you do not agree with an updated version of the Terms, please contact us before continuing to use our Services so that we can discuss your concerns.
